1. General

Surrogacy Guru (the "Site") is a personal blog operated by Erez Baron (the "Operator" or "I"), father to twins born through surrogacy in the United States. The Site exists to share knowledge and personal experience.

Use of the Site, including reading its contents, constitutes full acceptance of these terms. Anyone who does not accept them is asked not to use the Site.

For the personal information collected on the Site and how it is handled, see the Privacy Policy, which forms an integral part of these terms.

2. No professional advice

Nothing on the Site constitutes medical, legal, financial or any other professional advice, and nothing here substitutes for such advice. The Operator is not a physician, not an attorney and not a financial adviser.

Use of the Site, contact made through it, or correspondence with the Operator does not create an attorney-client relationship, a practitioner-patient relationship, or a professional advisory relationship of any kind.

Surrogacy law differs between countries, between states within the United States, and over time, as do medical practice and consular procedure. Information accurate when written may not be accurate when read.

Before making any decision, consult a qualified professional in the relevant jurisdiction.

The Operator is not a surrogacy agency, does not represent any agency, and receives no consideration for the content published on the Site.

3. The interactive tools

The Site provides interactive tools, including preparation questionnaires, comparison forms and question lists.

These tools are intended solely to help organise thinking and prepare for conversations with professionals. Their output is not a recommendation, not a professional assessment and not an opinion, and rests entirely on the data the user entered.

Data entered into the tools is stored in the user's own browser. It is not transmitted to or stored on the Site's servers. Clearing browser data deletes it, and the Operator cannot recover it.

4. Accuracy and absence of warranty

The content of the Site is provided AS IS and AS AVAILABLE, without representation or undertaking of any kind, express or implied, as to its completeness, accuracy, currency, or suitability for any particular purpose or for a particular user's circumstances.

Use of the Site and its content, and any reliance on either, is at the user's sole responsibility.

The Operator does not undertake that the Site will operate without interruption or fault, that it will be available at any given time, or that it will be free of viruses or other harmful components.

5. Limitation of liability

Subject to applicable law, the Operator shall bear no liability for any damage — direct, indirect, consequential, special or otherwise — including loss of profit, loss of opportunity, expenses incurred or non-pecuniary damage, caused to a user or to a third party as a result of use of the Site, reliance on its content, inability to use it, or any action taken or not taken in consequence of it.

This applies equally to content written in good faith and on the basis of the best knowledge available at the time of writing, which later proves inaccurate or out of date.

A user who believes there is an error in the content is invited to contact the Operator, who will review the matter and correct it as required.

6. Links to external sites and parties

The Site contains links to websites, agencies, clinics, foundations and organisations outside the Operator's control.

These links are provided for convenience only and do not constitute a recommendation, endorsement, sponsorship or guarantee as to the quality, availability, terms or legal compliance of any service. The Operator is not responsible for content on those sites, for their privacy practices, or for any dealing between a user and an external party.

Any engagement with an external party is made directly with that party and at the user's sole responsibility.

7. Intellectual property

All copyright and intellectual property rights in the content of the Site — including texts, articles, guides, questionnaires, images, illustrations, design, structure, source code and the name "Surrogacy Guru" — belong to the Operator, unless expressly stated otherwise.

A short and proportionate excerpt may be quoted, provided full credit is given to the Operator and an active link to the original page is included.

Except with the Operator's prior written permission, you may not:

  • copy, reproduce, distribute, transmit or republish substantial parts of the Site or a complete article
  • translate content from the Site and publish it
  • make any commercial use of the content, including in a paid service, in marketing materials or in advertising
  • create derivative works based on the Site's content
  • remove, alter or obscure any intellectual property notice, credit or attribution

Book covers, media logos, trademarks and third-party photographs belong to their respective owners and appear on the Site for identification, citation and reference purposes only.

The Operator asserts the moral rights in his works under the Copyright Act, 2007.

8. Prohibited uses

The Site may not be used for any unlawful purpose or contrary to these terms. In particular, you may not:

  • interfere with the proper operation, availability or security of the Site
  • carry out automated collection, scraping or systematic extraction of content beyond reasonable use
  • attempt to access areas or information not open to the public
  • impersonate the Operator, or create the impression of a connection, collaboration or sponsorship that does not exist
  • use contact details gathered from the Site for marketing or commercial approaches

9. Changes to the terms and to the Site

The Operator may update these terms from time to time. An updated version will be published on this page and the date at the top amended accordingly. Continued use of the Site after publication of an updated version constitutes acceptance of it.

The Operator may change the Site's structure, content and scope of services, and may discontinue it, at any time and at his sole discretion, without prior notice and without any claim arising in consequence.

10. Governing law and jurisdiction

These terms, and any matter arising from use of the Site, are governed solely by the laws of the State of Israel, excluding its conflict-of-laws rules.

Exclusive jurisdiction over any dispute lies with the competent courts of the Tel Aviv-Jaffa district.

11. General provisions

If any provision of these terms is found unenforceable or void, the remaining provisions remain in force, and that provision shall be construed so as to give effect to its purpose so far as the law permits.

The Operator's failure to enforce any right shall not be treated as a waiver of it.
